Daintree Eco-Lodge Booking Conditions

Please read and understand the conditions of booking set out below (Booking Conditions) prior to booking a room with us as they set out your legal rights and obligations in relation to your booking.

1. Our contract

1.1 Your contract is with Intrepid Daintree Eco-Lodge Pty Ltd (Intrepid/ us/ we) for your booking at the Daintree Eco-Lodge (the Hotel). By booking a room with us you have agreed to be bound by the terms and conditions set out below, along with any additional terms that may apply to your use of the Hotel facilities, including but not limited to the spa, restaurant and pool.

1.2 In these Booking Conditions references to “you” and “your” include the first named person on the booking and all persons on whose behalf a booking is made or any other person to whom a booking is added or transferred.

1.3 Promotional deals, packages and special events offered or arranged by us may be subject to special terms and conditions (Special Conditions) These Special Conditions will be made available to you at the time you make your booking. To the extent of any inconsistency between Special Conditions and these Booking Conditions, the Special Conditions will prevail to the extent of the inconsistency in relation to the specific deal, package or event.

2. Privacy Policy

Any personal information that we collect about you will be handled in accordance with our Privacy Policy.

3. Deposit

3.1 You are required to pay a deposit for your booking to be confirmed. The deposit amount is the price of the first night of your booking.

3.2 If your booking is made within 30 days of your arrival date, then the full amount is payable at the time of booking. Deposit amounts may vary for selected rooms and special campaigns that may be run by us from time to time, as set out in and subject to any Special Conditions which will be provided to you at the time of booking.

4. Acceptance of booking and final payments

4.1 A contract will exist between you and us from the date when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments, including how to make the payment. Payment of the balance of your booking is due 30 days prior to arrival. If this balance is not paid on or before the due date, we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 6 (Standard Cancellation Policy) will apply.

4.2 Reservations are subject to availability and actual pricing at the time of booking. Specific rooms may allocated in the Hotel’s discretion. All prices quoted are in Australian Dollars. We accept no responsibility for any differences in currency exchange rates or refunds relating to currency exchange fluctuations.

4.3 All bookings must be guaranteed at the time of reservation by provision / deposit of valid credit card details. This credit card must be valid for the entire stay. Please present the credit card used to make the reservation upon check-in at the Hotel. If you are booking on behalf of someone else, you must contact the motel directly to arrange for third party billing. By providing valid credit card details you warrant that you have the authority to use the credit card and you authorise the Hotel to charge the cost of your booking to the credit card in the case of cancellation or no show penalties as detailed below. Any additional charges incurred during your stay at the Hotel will be charged upon checkout. You will be liable for any credit card service fees.

5. Identification

Upon arrival at the Hotel, You must provide official photographic identification for security purposes. If you are making a booking on behalf of another person or persons, you must provide the Hotel with the contact details for the person or persons named in the booking.

6. Standard Cancellation Policy

We would be disappointed if your booking was to be cancelled. However, we realise circumstances occasionally make this necessary. Cancellations must be advised in writing and the following conditions will apply:

(a) 31 days or more prior to your check-in date, no cancellation fee will apply;

(b) 30 days or fewer prior to your check-in date, we charge a cancellation fee of 100% of your booking cost.

In the unlikely event that we have to cancel your booking, you can transfer amounts paid to an alternate booking date or receive a refund. Please see clause 13 for more information about cancellations due to a Force Majeure Event.

7. No shows

“No Shows” will be subject to a minimum charge of one night’s room charge, to a maximum of all room nights booked, at the contracted rate for the entire stay.

8. Change of date (postponement)

8.1 The Hotel understands that you may need to change the date of your booking. We will attempt to be flexible with any changes of date where space is available. Provided we are advised 31 days prior to arrival, no change fee will apply. If you wish to change the date of your booking within 30 days of your booking 100% of the deposit will be retained by the Hotel as a cancellation fee and the remaining deposit will be allocated to the new booking. The Hotel will only accept one postponement per booking. Please be aware that all bookings postponed are subject to new packages, prices and conditions – a new agreement will apply.

8.2 You agree that under these cancellation terms all cancellation fees payable by you will be charged to the credit card provided at the time of making your booking or an amount equal to the full booking value will be forfeited to the Hotel.

9. Check in and Check out times

Standard check in time is 2.00pm. The name of the booking (or nominee) must be the person checking in. Standard check out time is 10.00am. Late checkouts are available upon request. Please contact reception to check availability. Additional fees may be applied. A late check-out fee may apply if the property is not vacated prior to the set check-out time of the property.

10. Child policy

Children of all ages are welcomed. As the parents, guardians or chaperones of children you are personally and legally responsible for and must supervise them at all times. For safety reasons please do not leave children unattended in guest rooms or allow them to roam the hotel property unsupervised. A maximum of three guests per room. If a fold out bed or cot is required, an additional charge will apply. For the purpose of this clause “Child” or “Children” means a person or persons aged between 2 years and 17 years; “Infant” means a person under the age of 2 years; and “Adult” means a person aged 18 years or over. All ages will be determined from the date at which accommodation commenced. Children and infants may not stay in any room without an adult.

11. Dietary Requirements and Allergies

11.1 A daily breakfast is included in the room rate. Our Executive Chef will be able to accommodate most special dietary requirements. Any dietary requests requiring specialised food/attention surcharges will apply.

11.2 Please note that some dishes may contain traces of allergens that could have implications for patrons with food-related allergies, health conditions or intolerances. Although we will endeavour to accommodate all guest’s dietary and allergy needs, the Hotel cannot be held responsible for any harm suffered from the presence of these traces, and you release the Hotel in respect of any claims.

12. Beverage

Unless with prior written agreement from the Hotel, no beverages may be brought onto the Hotel’s premises by any party. The Hotel adheres to responsible service practices as prescribed under applicable liquor licensing laws. Alcohol will be denied to anyone deemed to be underage or intoxicated.

13. Limitation of liability

13.1 To the extent permitted by law, such as the Australian Consumer Law, the Hotel excludes all liability for any loss or damage whatsoever that may arise in any way in connection with the offer of services by the Hotel or any third party service providers, or in connection with the supply of such services. If the Australian Consumer Law or any similar law implies a condition or warranty that cannot be excluded, to the maximum extent permitted by law the liability of the Hotel for a breach of the condition or warranty will be limited to:

(a) the supplying of the services again; or

(b) the payment of the cost of having the services supplied again.

13.2 To the extent permitted at law, neither party shall be liable to the other for any Consequential Loss. Consequential Loss means any:

(a) loss of profits, loss of revenue, loss of data, loss of or damage to reputation, loss of or damage to goodwill, loss of business opportunities (including opportunities to enter into or complete arrangements with third parties), loss of management time, damage to credit rating, or loss of business; and

(b) any loss, not arising naturally (that is according to the usual course of things), from the relevant breach, whether or not such loss is reasonably supposed to have been in the contemplation of both parties, at the time they made this Agreement, as the probable result of the relevant breach.

13.3 Nothing in these Booking Conditions shall limit, any party’s liability:

(a) for death or personal injury caused by its negligence or wilful misconduct or that of caused by that party or its personnel;

(b) for fraud (including fraudulent misrepresentation) by it or its personnel; or

(c) to the extent applicable, for misleading or deceptive conduct under section 18 of the Australian Consumer Law;

(d) where liability cannot be limited or excluded by applicable law.

14. Force Majeure

14.1 The Hotel is not responsible for any liability or loss arising out of any Force Majeure Event.

14.2 A “Force Majeure Event” includes but is not limited to: acts of God; war; civil commotion; riot; blockade or embargo; fire; explosion; breakdown; union dispute; earthquake; epidemic, pandemic or other health emergency; flood; windstorm or other extreme weather event; lack or failure of courses of supply; passage of any law, order, proclamation, regulation, ordinance, demand, requisition or requirement or any other act of any government authority, beyond the reasonable control of the parties, whether or not foreseeable, which would make it dangerous or not viable for a trip to commence or continue.

14.3 You have the right to cancel your booking before arrival, and we may be required to cancel your booking due to a Force Majeure Event. In these circumstances, we shall provide you with a full refund of the monies you have paid but we will not be liable to pay you any additional compensation (provided we have notified you without undue delay before your arrival date).

14.4 In the event of any cancellation, there will be no claim for damages by either party against the other and we are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

15. Dress Code

Tidy dress is required in all restaurants or lounge bars. Guests may be denied access at the discretion of management or security.
